Irregularities in municipality-owned companies outside the sphere of public utility

The possibility of municipalities performing municipal management in the form of commercial companies arises primarily from Article 9 par. 2 of the Act on Municipal Management, which states that local government units can create limited liability or joint-stock companies, and can also participate in them.
In practice, municipalities very often make use of this possibility. Statistics show that commercial companies are the form of exercising municipal management that municipalities most frequently choose. Ministry of the State Treasury data reveal that in 2013 as many as 220 new municipality-owned limited liability and 22 joint-stock companies were created.
