No protection in case of premeditation – an article by Jolanta Zarzecka-Sawicka in Rzeczpospolita

PENALTIES | If an employee wilfully destroys a company machine or computer, he or she will be charged in full. If the damage was caused unintentionally, the perpetrator will only return his or her three-months’ earnings.

The Labour Code specifies employee’s material liability separate from the civil code. The code is more lenient to employees in the scope of burden of proof, limiting the extend of the loss to be compensated for, or the impact of the type of guilt on the amount of compensation.
