FKA Furtek Komosa Aleksandrowicz advised on the financing of a windfarm project of the WPM MOSTY group by Alior Bank

FKA Furtek Komosa Aleksandrowicz advised Alior Bank on the financing of a medium-sized windfarm project in the Pomerania region (a project owned the group of Warszawskie Przedsiębiorstwo Mostowe MOSTY) through investment and revolving credit facilities.

The bank’s total engagement (including limits on foreign exchange and interest rate hedging) amounted to over PLN 115 million. 

FKA was the sole legal counsel in this transaction and its advice involved legal due diligence, preparing the facilities and security documents, as well as negotiating key contracts for turbine delivery and maintenance service with Siemens and assisting in fulfilling conditions precedent to the first drawdown.

The FKA team was led by Leszek Rydzewski, the head of the financial institutions and restructuring department, supported by among others Marta Bosiak, associate in the corporate department, specialising in real estate, who has recently joined FKA.

This time we have had the chance to prove the efficiency of our legal advice as the change of law on supporting renewable energy projects required a swift reach of agreement and closing of the financing of the windfarm project and immediate facility disbursement,” said Leszek Rydzewski.
