The overall economic situation in Poland does not create favourable conditions for dynamic increase in the number of cases heard by arbitration courts. However, we can observe a considerable increase of applications brought by companies from the infrastructure sector, Marek Furtek, the President of the Court of Arbitration at the Polish Chamber of Commerce, has told the ISBnews agency.
“In the course of erecting new public utility facilities, such as motorways, national roads, airports or expansion of seaports, many contentious issues may arise between parties to an agreement. More often than not, they are a consequence of unexpected, both to the investor and the contractor, factual circumstances which occur during the construction process” – says Mark Furtek.
