On 18 January 2015, an amendment to the act on competition and consumer protection will come into effect. The aim of the amendment is to provide support to the Office of Competition and Consumer Protection in more efficient detection of competition law violations. The new regulations concern both business entities themselves as well as their executive officers.
Comments
The amendment introduces the notion of personal liability of management board members for violating provisions of competition law. Financial penalties for such violations may be as high as two million zlotys.
Analysis
Personal liability of executive officers will occur together with liability of a business entity itself. In order to hold an executive officer liable for a violation, the existence of several pre-conditions will need to be proven by the President of the Office of Competition and Consumer Protection.
